Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Diimsum, including our website, dashboard, software, APIs, integrations, and related services (collectively, the “Service”).

The Service is operated by Vivacity Limited (“Vivacity,” “Diimsum,” “we,” “us,” or “our”).

By creating an account, subscribing to the Service, connecting an integration, or otherwise using Diimsum, you agree to these Terms.

If you are using Diimsum on behalf of a company or other organization, you represent that you have authority to accept these Terms on its behalf.

1. What Diimsum Does

Diimsum helps game developers, publishers, and community teams understand player feedback across supported community and social platforms.

Depending on the integrations you connect, Diimsum may collect and organize authorized data from sources such as Discord, Steam, Reddit, and other supported platforms.

Diimsum may provide features including:

• feedback organization and classification

• topic and issue detection

• sentiment analysis

• translation

• summaries

• trends and analytics

• search and retrieval

• alerts and reports

Some features may use artificial intelligence or machine-learning models to analyze and organize information.

2. Accounts

You are responsible for maintaining the confidentiality and security of your account credentials.

You are responsible for activity conducted through your account and for ensuring that users you authorize to access your workspace comply with these Terms.

You must provide accurate information when creating or maintaining an account.

You must notify us promptly if you believe your account has been compromised or used without authorization.

3. Your Data

You retain your rights in the data, content, and information that you or your authorized integrations provide to Diimsum (“Customer Data”).

You grant us a limited right to process Customer Data only as necessary to:

• provide and operate the Service

• perform requested analysis

• maintain and secure the Service

• provide support

• comply with applicable law

• fulfill other purposes described in our Privacy Policy

This permission does not transfer ownership of your Customer Data to us.

You are responsible for ensuring that you have the necessary rights and permissions to connect data sources to Diimsum and allow us to process the resulting data.

4. Third-Party Integrations

Diimsum may connect with third-party platforms and services.

You may only connect accounts, servers, communities, workspaces, or other resources that you are authorized to connect.

Your use of third-party services remains subject to the terms and policies of those services.

Third-party platforms may change, restrict, suspend, or discontinue access to their APIs or services at any time. We are not responsible for changes made by third-party platforms that affect an integration.

Certain integrations may also have additional privacy information.

6. AI and Automated Analysis

Some Diimsum features use artificial intelligence, machine learning, or automated systems to classify, summarize, translate, group, or analyze information.

These systems may occasionally produce incomplete or inaccurate results.

You are responsible for evaluating outputs before relying on them for important business decisions.

Unless specifically stated otherwise, Diimsum's AI-generated outputs are intended to assist human decision-making rather than replace it.

7. Acceptable Use

You may not use Diimsum to:

• violate applicable laws or regulations

• access data that you are not authorized to access

• violate the rights of another person or organization

• bypass security or access controls

• interfere with or disrupt the Service

• attempt to gain unauthorized access to Diimsum systems

• reverse engineer the Service except where permitted by law

• introduce malware or malicious code

• use Diimsum to spam, harass, stalk, or target individuals

• use data obtained through Diimsum for unlawful surveillance

• resell access to the Service unless we have agreed to this in writing

• use the Service in a way that violates the terms of a connected third-party platform

We may restrict or suspend access where necessary to protect the Service, our users, third parties, or platform partners.

8. Fees and Subscriptions

Some Diimsum features require a paid subscription.

Pricing, billing periods, usage limits, and included features may be described on our website, order form, proposal, or other agreement with you.

Unless otherwise stated:

• fees are charged in advance for the applicable billing period

• fees are non-refundable except where required by law or expressly agreed otherwise

• you are responsible for applicable taxes

• subscriptions may renew automatically until cancelled

If a separate order form, commercial agreement, or subscription agreement applies to your account, that agreement will control in the event of a conflict regarding pricing, payment, subscription period, or commercial terms.

9. Intellectual Property

Diimsum, including its software, interface, branding, models, workflows, documentation, and underlying technology, is owned by Vivacity Limited or its licensors.

These Terms do not transfer ownership of the Service to you.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use Diimsum during your authorized subscription or access period.

You retain ownership of your Customer Data.

10. Feedback

If you provide suggestions, ideas, or feedback about Diimsum, you allow us to use that feedback to improve our products and services without restriction or payment to you.

This does not give us ownership of your Customer Data.

11. Confidentiality

If either party receives non-public business, technical, or commercial information from the other party that is reasonably understood to be confidential, the receiving party will use reasonable measures to protect that information and will use it only for purposes related to the Service.

This section does not apply to information that:

• is publicly available through no breach of these Terms

• was already lawfully known to the receiving party

• is independently developed without use of the confidential information

• is lawfully received from another source without confidentiality obligations

Disclosure may also be made where required by law.

12. Service Availability

We work to keep Diimsum available and reliable, but we do not guarantee uninterrupted or error-free operation.

The Service may occasionally be unavailable because of maintenance, technical issues, third-party platform changes, outages, or other circumstances.

We may modify, add, or remove features as the Service evolves.

13. Suspension and Termination

You may stop using Diimsum at any time.

We may suspend or terminate access to the Service if:

• you materially violate these Terms

• required fees remain unpaid

• your use creates a security or legal risk

• your use violates the rules of a connected third-party platform

• we are required to do so by law or a platform provider

• continued access could harm Diimsum, our users, or third parties

Where reasonably possible, we will provide notice before terminating an account for reasons other than urgent security, legal, or platform compliance concerns.

14. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that automated analysis, AI-generated content, summaries, classifications, sentiment results, or other outputs will always be complete or accurate.

15. Limitation of Liability

To the maximum extent permitted by law, Vivacity Limited will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, or business opportunities.

To the maximum extent permitted by law, our total liability arising out of or relating to the Service will not exceed the amount paid by you to us for the Service during the twelve months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold Vivacity Limited harmless from claims, losses, damages, liabilities, and reasonable expenses arising from:

• your unlawful use of the Service

• your violation of these Terms

• your infringement of another party's rights

• data or integrations that you connect without appropriate authorization

17. Changes to These Terms

We may update these Terms as Diimsum changes or as legal, security, or platform requirements evolve.

The updated Terms will be posted on this page with a revised “Last Updated” date.

If a change materially affects your rights or obligations, we may provide additional notice where appropriate.

Continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region.

Any dispute arising from or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Hong Kong, unless another written agreement between you and Vivacity Limited provides otherwise.
